Where the term PAV is used in these ‘terms and conditions’; that abbreviation shall be taken to mean; Peterfield Antique Village, it’s Principals/Owners, it’s members of staff or it’s servants. The term Dealer used in these terms and conditions shall mean any independent trader using this website to sell products or services or otherwise conduct business. The term Customer or Visitor shall mean any visiting potential buyer or general visitor to the Website.
General Terms and Conditions
This web-site is Owned by PAV and is run by Agents of PAV. The website is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transaction there are risks involved and we strongly advise you to understand all of these terms before any Dealer uses the Website or any Customer buys from any Dealer. If you see a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting PAV.
Rights To Suspend or Terminate
Dealers agree that PAV, in its own discretion, may terminate any Dealer or use by a Dealer of the service immediately and without notice if (Inter alia) :
(a) PAV believes that a Dealer is not abiding by the general rules of this web-site
(b) Has repeatedly broken a certain term
(c) Has listed a suspicious item
(d) PAV believes a Dealer to be a contravening the Laws of the United Kingdom or is otherwise not fulfilling their responsibilities to members of the public who are their customers.
In most cases if PAV suspects’ foul play by a Dealer PAV will suspend the Dealer’s account/listing whilst PAV investigates further notifying the Dealer of the action. If the investigation is conclusive then Dealer’s account/listings with us will be terminated.
Dealer’s Conduct
Dealers are solely responsible for the contents of their actions through this web-site. Dealers must ensure that their participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that Dealers must check that they are entitled to sell or buy any relevant item and that they are not prohibited from doing so by any law or regulation.
Dealers must not transmit through the Website service any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. They must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.
Membership
Membership to this web-site is only available to those Dealers who can form a legally binding contract therefore this web-site does not permit Dealers to be ‘Minors’ in the eyes of the Law ( minors being under 18 years of age) to register as Dealers. If any Dealer falsifies their correct age their account will be terminated immediately.
General Terms
This Website acts as the window for Dealers to conduct sales and advertising off their products and for customers/the general public to buy from Dealers either directly or on-line. PAV are not involved in the actual transaction between Dealers and customers. As a result, PAV has no control over the quality, safety or legality of the items listed or of the truth or accuracy of the Dealers Products/services or listings, nor of the ability of Dealers to sell items or the ability of customers to buy items. PAV cannot and does not control whether or not Dealers will complete the sale of items they offer or, customers will complete the purchases of items they have promised to buy.
In addition, please note that where international sales are concerned there are risks of dealing with foreign nationals, underage persons or people acting under false pretence. It is the responsibility of the Dealer to ensure their safety in this regard.
This Web-site and its Owners, (PAV as described above) shall not be responsible for any items sold by Dealers, for any damage to items during transit or during any agreed inspection period, nor for misrepresentations and/or breaches of contract by either customer and/or dealer. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.
This web-site assumes no liability for the content of the listings.
However if either Dealer or Customer fall victim to a fraudulent transaction PAV will assist as much we can.
The Internet being the fragile environment that it is, PAV cannot be held responsible for server down time, or for inability to access PAV’s site. Notifications sent by email may take longer than expected, and cannot be counted on to inform you of an item's status. In the event of technical problems PAV or it’s Agents will make every endeavour to ensure the correct functioning of the Website.
Hold Harmless
PAV, its principals, its employees and or its heirs shall be held harmless from any liability or damages as a result of Dealers misusing this site or from disputes between Dealers and their customers or from claims of damage from one Dealer over another Dealer. The Dealers agree that the Website of PAV simply is a convenient place for interested Dealers to transaction business, and PAV shall have no liability because of disputes or injuries that result from such transactions. Dealers are advised to beware of any person and only continue with a transaction if they have decided the person they are dealing with is trustworthy. PAV cannot guarantee that its Dealers or Users/customers are following the law it is up to the parties involved to determine the legalities governing their own businesses.
Laws.
These Terms of Service shall be governed by and constructed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England Scotland and Wales.
